1. Introduction

1.1 These Terms govern your use of ludo.mt and all related services, features, and communication channels (the "Platform").

1.2 "Ludo.mt" is the Platform name. "We", "our", and "us" refer to its operator. You can contact us through the Contact Us page.

1.3 These Terms govern use of the Platform. Our Privacy Policy and Cookie Policy explain personal-data processing and device storage; using the Platform does not constitute consent to optional processing.

1.4 If you act on behalf of another person or entity, you must have the authority required for the instructions and information you provide.

2. Definitions

2.1 In these Terms:

2.2 Headings are for convenience only. "Including" means "including without limitation". References to legislation include amendments and replacements in force from time to time.

3. What the Platform Is (and Is Not)

3.1 The Platform is free to use and focuses on property in Malta and Gozo. It enables users to browse listings, create accounts, save searches, receive notifications, manage favourites, and communicate with us.

3.2 The Platform is not a valuation service, legal practice, financial adviser, property broker, or estate agency.

3.3 The advertising service does not negotiate, arrange, or conclude property Transactions. Advertising a property does not appoint us as an estate agent or authorise us to bind a property party.

3.4 Features may change for technical, security, legal, or operational reasons, subject to applicable law and the notice provisions below. Accounts, verification, and privacy controls remain necessary for protected features; no subscription is required.

4. Eligibility

4.1 You must be at least 18 years old and have legal capacity to enter a binding agreement under Maltese law.

4.2 By using the Platform, you represent that all information you provide is accurate and that you are not acting in contravention of any law, court order, or regulatory restriction.

4.3 You may use the Platform only for lawful property-related activity and must not misrepresent your identity, authority, or professional status.

4.4 If we believe you are under 18 or have provided false information, we may terminate your access without notice.

5. Accounts

5.1 Certain features require an Account. Registration may be restricted for eligibility, verification, security or legal reasons, subject to applicable law.

5.2 You are solely responsible for maintaining the security of your Account, devices, and credentials, and for all activity under your Account.

5.3 You must keep your information accurate and up to date.

5.4 We may impose verification requirements, access limits, and security measures as we see fit.

6. Access Controls

6.1 We may apply verification, security, device, and usage controls to any feature.

6.2 Access may be refused, restricted, suspended, or revoked where necessary to protect users, personal data or Platform integrity.

7. Acceptable Use

7.1 You may use the Platform only for its intended purpose: lawful property browsing, genuine enquiries, account management, and related activity.

7.2 Your right to use the Platform is limited, personal, revocable, non-exclusive, non-transferable, and conditional on compliance with these Terms.

7.3 Access restrictions must relate to the purposes in sections 6, 19 and 20 and be proportionate to the circumstances, subject to applicable law.

8. Prohibited Conduct

8.1 You must not:

  1. impersonate another person or entity, or misrepresent your identity or status;
  2. provide false, misleading, or incomplete information;
  3. use the Platform to facilitate any unlawful activity;
  4. engage in spam, harassment, threats, abuse, or intimidation;
  5. upload malware, viruses, or harmful code;
  6. attempt to bypass or circumvent any security measure, authentication, rate limit, or access restriction;
  7. scrape, crawl, harvest, mirror, frame, deep-link, or systematically extract content, data, images, or contact details from the Platform;
  8. use any automated tool, bot, or script to access the Platform unless expressly authorised by us in writing;
  9. interfere with the security, performance, or availability of the Platform;
  10. use Owner Contact Details for any purpose other than a genuine enquiry relating to the specific listing;
  11. resell, redistribute, or commercially exploit any data, content, or access obtained through the Platform;
  12. use Platform content to train AI or machine-learning systems;
  13. attempt to re-register after suspension, termination, or blocking without our written consent; or
  14. circumvent blocking measures (including through number rotation, VPNs, or new accounts).

8.2 Breach of this section is a material breach entitling us to exercise all available remedies, including immediate termination.

9. Property Listings

9.1 Listings are entered, managed and published by administrators using information supplied for advertising. Submitting details does not guarantee publication. Listing controls are subject to the moderation and review provisions below.

9.2 Information in listings is supplied by third parties and has not been independently verified by us unless expressly stated. We make no representation as to its accuracy, completeness, legality, or current availability.

9.3 We are not a party to any Transaction. You must carry out your own due diligence and obtain independent professional advice before acting on any Property Data.

9.4 Those supplying listing information must have authority to advertise, provide accurate and lawful material, disclose required property and energy-performance information, and promptly request corrections when details or availability change.

9.5 For internal listing-confirmation and administration workflows, we may require specific data formats and validation rules (including numeric-only fields and date formatting such as YYYY-MM-DD). We may reject, block, or require correction of non-conforming submissions.

10. Listing Prices

10.1 Listing prices are informational only and do not constitute an offer.

10.2 Asking prices must be accurate and must not be inflated to conceal intermediary commission. Material additional charges and any legally required pricing information must be clearly explained; a net asking price must not be presented as an all-inclusive price where it is not. Property prices are not charges for using the Platform.

11. Images and Media

11.1 Images must depict the property lawfully and clearly. We may process, resize, compress, reorder, or remove images at our discretion.

11.2 Prohibited content includes (without limitation): explicit, violent, hateful, or illegal material; sexualised content involving minors (zero tolerance); doxxing material; misleading overlays; and irrelevant images.

11.3 Those supplying images must hold the necessary rights and authorise the non-exclusive use, hosting, resizing and display needed to operate and promote the relevant listing. Service providers may process images for those purposes. This does not transfer ownership or authorise unrelated use, and personal-data rights remain applicable.

11.4 Serious or repeated violations may result in account suspension, permanent blocking, and referral to the authorities.

12. Owner Contact Details

12.1 Owner Contact Details are private and are not available through public or registered-user property views.

12.2 Authorised administrators use Owner Contact Details for listing administration, subject to applicable data-protection requirements.

12.3 Registering an Account does not grant access to private owner or viewing-contact details. Use the Platform's public support contacts for listing enquiries.

12.4 You must not use Owner Contact Details for spam, unsolicited marketing, harassment, bulk outreach, database building, resale, sharing with third parties, or any purpose other than a genuine enquiry for the specific listing. Breach of this clause is a material breach.

12.5 We do not guarantee that Owner Contact Details are accurate, current, or that the owner will respond.

13. Search Preferences

13.1 Registered users may save, edit, and delete property search preferences.

13.2 Saved-search notifications depend on listing availability and matching criteria; we do not guarantee that a matching property will be published or remain available.

14. Communications

14.1 Verification codes, requested saved-search notifications, account notices, and legally required messages support the service you request. Creating an Account is not blanket consent to marketing.

14.2 You may opt out of non-essential communications where we provide that option. Essential messages may still be sent.

14.3 We are not responsible for delivery failures caused by third-party infrastructure, carriers, or devices. Carrier charges are your responsibility.

15. Intellectual Property

15.1 Rights in software, branding, designs, listing text, photographs and other material remain with their respective owners or licensors. Publication does not transfer ownership or imply affiliation with another business.

15.2 You may use the Platform for its intended functions. Other reproduction or commercial exploitation requires the relevant right holder's permission, except where permitted by law. These Terms do not override statutory copyright exceptions.

15.3 Unauthorised use may result in immediate suspension, permanent blocking, injunctive proceedings, and claims for damages and account of profits under the Copyright Act (Chapter 415), the Commercial Code (Chapter 13), and other applicable law.

16. Data Protection

16.1 We process personal data in accordance with the GDPR, the Data Protection Act (Chapter 586), and our Privacy Policy.

16.2 You must not misuse or unlawfully disclose personal data obtained in connection with the Platform. Any independent data-protection obligations depend on your actual processing activities and applicable law; accessing information does not itself determine your legal role.

16.3 Further details of data categories, legal bases, processors, and your rights are set out in our Privacy Policy.

17. Cookies

17.1 The Platform uses strictly necessary cookies only: a session cookie for secure sessions and a persistent device-security cookie used for login protection and device-management controls. No analytics, advertising, or tracking cookies are currently used.

17.2 See our Cookie Policy for further details. We may introduce additional cookies in future and will update our Cookie Policy accordingly.

18. Third-Party Services

18.1 The Platform relies on third-party providers for communications, hosting, content delivery, and related infrastructure.

18.2 Third-party services may experience outages or failures. Their involvement does not remove our own obligations under applicable contract, consumer or data-protection law.

18.3 Details of our processors and data-sharing arrangements are set out in our Privacy Policy.

19. Moderation and Enforcement

19.1 Administrators review and manage listings and reports. Restrictions may address unlawful or misleading content, missing authority or required property information, infringement, fraud, spam, security risks, or breaches of these Terms. Measures must be proportionate and take account of the circumstances and affected rights. The current listing workflow does not automatically assess images for legality.

19.2 Where applicable law requires reasons for a content or account restriction, we must provide them, including its basis, scope, any use of automated means, and available redress. You may request review through Contact Us. Statutory complaint and court rights remain available.

19.3 We are under no general obligation to monitor user content. Where we obtain actual knowledge of illegal content, we will act in accordance with applicable law.

20. Suspension and Termination

20.1 We may suspend, restrict, block, or terminate access where reasonably justified by the following circumstances. Urgent action may precede notice where needed for safety, security or legal compliance, subject to applicable notification and review rights:

  1. any breach or suspected breach of these Terms;
  2. fraud, abuse, harassment, or suspected unlawful activity;
  3. misuse of personal data;
  4. false or misleading information;
  5. circumvention of restrictions or blocking measures;
  6. security, legal, or reputational risk; or
  7. another substantiated risk to users' rights or the lawful and secure operation of the Platform.

20.2 Rights and obligations accrued before termination survive, including liability for breach.

20.3 We are not obliged to allow re-registration after blocking.

20.4 We may retain records after termination where necessary for legal, compliance, evidential, or legitimate business purposes.

21. Reporting and Complaints

21.1 Use Report Abuse to report unlawful content or conduct. Identify the exact listing URL or content location and explain why you believe it is unlawful. The form requests contact details and a good-faith statement; a reporting exception applies for suspected child sexual abuse material. Do not send copies of illegal imagery.

21.2 We will assess reports in accordance with our obligations under applicable law and may take action where appropriate, but submission of a report does not guarantee a specific outcome.

21.3 You may ask us to review a decision through Contact Us. Applicable Digital Services Act rights, including complaints to the Malta Communications Authority as Digital Services Coordinator, are not excluded. Additional statutory review procedures apply where their legal conditions are met.

22. Disclaimers

22.1 The Platform is primarily a digital listing, search, notification, and favourites service. We do not provide legal, financial, valuation, architectural, surveying, or other professional advice. We owe no fiduciary or advisory duty.

22.2 Listings may be incomplete or become outdated, and the service may be interrupted. These limitations do not exclude statutory standards, remedies or obligations that apply to us.

22.3 We do not warrant that any listing is accurate, lawful, or current; that any property exists or matches its description; that any user is truthful, licensed, or solvent; or that any Transaction will occur.

22.4 You are solely responsible for independent due diligence and professional advice before acting on any information from the Platform or entering any Transaction.

22.5 Nothing in these Terms excludes mandatory consumer rights that cannot lawfully be excluded.

23. Limitation of Liability

23.1 Our responsibility for loss or damage is determined by applicable law, including mandatory consumer protections.

23.2 The Platform is free to use. These Terms impose no fee-based liability formula or fixed monetary cap.

23.3 Nothing excludes or limits liability for fraud, gross negligence, death or personal injury where the law prohibits exclusion, or any other liability that cannot lawfully be limited.

23.4 Property parties remain responsible for their own Transactions. This does not exclude responsibility arising from our own breach of a legal or contractual duty.

23.5 Mandatory remedies under consumer, data-protection and digital-services law remain available.

23.6 Providing the service free of charge does not waive users' statutory rights.

24. Indemnity

24.1 You remain responsible, to the extent provided by applicable law, for loss caused by your unlawful or wrongful conduct in connection with:

  1. your breach of these Terms;
  2. your use or misuse of the Platform or personal data;
  3. your content or conduct;
  4. your violation of any law or third-party right; or
  5. any Transaction, interaction, or dispute between you and any third party.

24.2 This section creates no automatic duty to indemnify us, fund our defence, or compensate us for our own fault. Any claim and recoverable costs remain subject to applicable law.

25. Force Majeure

25.1 Events beyond reasonable control may affect service availability. Their effect on obligations and liability is subject to applicable law and does not excuse a failure to meet duties that remain legally applicable.

26. Availability and Changes

26.1 We may modify or discontinue features for technical, security, legal or operational reasons, subject to applicable rights and notice requirements. The current Platform is free to use.

26.2 We do not guarantee continuous availability.

26.3 Changes must not remove rights that cannot lawfully be excluded.

27. Assignment

27.1 You may not assign your rights or obligations under these Terms without our written consent. Any purported assignment is void.

27.2 An assignment or subcontracting arrangement must comply with applicable law and must not diminish mandatory consumer or data-protection rights.

28. Notices

28.1 We may send service notices through the Platform or the email or WhatsApp details associated with your Account, subject to applicable delivery requirements.

28.2 Notice delivery and any resulting time limits are assessed under applicable law. Please keep your account contact details current.

28.3 Notices to us must be sent through the Contact page on the Platform.

29. Governing Law and Disputes

29.1 These Terms are governed by the laws of Malta.

29.2 Business users submit to the exclusive jurisdiction of the courts of Malta.

29.3 Consumer users retain mandatory protections of their applicable national law and jurisdictional rights, including under EU Regulation 1215/2012 where applicable. The availability of a court or tribunal depends on its statutory jurisdiction.

29.4 Consumer redress information is available from ECC Malta and the relevant consumer authority. The former EU ODR platform has closed.

29.5 You may contact us to seek an informal resolution. Doing so is not a precondition to exercising statutory rights, seeking urgent relief, or complaining to a regulator.

30. Changes to These Terms

30.1 We may amend these Terms by publishing an updated version with a new effective date.

30.2 Significant changes must be communicated as required by applicable law, including applicable Digital Services Act requirements.

30.3 Changes apply prospectively, subject to mandatory notice and agreement requirements. An update to a privacy notice does not itself authorise a new processing purpose or replace consent where required.

31. General Provisions

31.1 Severability. If any provision is held invalid or unenforceable, it shall be modified to the minimum extent necessary or severed. The remainder continues in full force.

31.2 Waiver. No delay or failure to exercise any right constitutes a waiver.

31.3 These Terms govern general Platform use. The Privacy Policy and Cookie Policy explain processing and storage and do not replace a lawful basis or required consent.

31.4 Survival. Provisions relating to intellectual property, data protection, disclaimers, limitation of liability, indemnity, governing law, and any other provisions which by their nature should survive, survive termination of these Terms.

32. Contact

32.1 For questions, complaints, legal notices, or support, please use the contact form on the Platform or the communication channels published there.

Please read these Terms before registering or providing listing instructions. The relevant workflow requests agreement where required.
